  1. Instructions for Actions After a Traffic Accident with Injuries<\/b><\/li>\n<\/ol>\n

     <\/p>\n

    1.1 Call Emergency Services<\/b><\/p>\n

    Call the <\/span>100 <\/b>Police Emergency Number<\/span> and the <\/span>101 <\/b>Magen David Adom Emergency Number<\/span> and note the location of the accident, the number of vehicles involved, and the number of people hurt. Check for other hazards such as pieces of metal on the road, oil stains, or fuel leaks and inform the <\/span>Fire Department \u2013 at the <\/span>102<\/b> Call Center.<\/span> Try to be available via telephone if the emergency services are having a hard time finding the site of the accident. <\/span><\/p>\n

    1.2 Do not move injured people<\/b>: Movement can make injuries worse, and therefore, if injured people are not at risk due to fire or fuel leaks, leave them where they are and call Magen David Adom. <\/span><\/p>\n

    1.3 Do not move the vehicle<\/b>: the location of the vehicle in an accident helps police and professionals determine the cause of the accident. Moving vehicles away from an accident with injured people without the presence of the police is a criminal offense. <\/span><\/p>\n

    1.4 Place a warning triangle<\/b>: Place the warning triangle 50-100 meters from the site of the accident in order to signal to other drivers and provide them with a reasonable response time. If the accident occurred at night, turn on the vehicle’s headlights and blinkers to illuminate the area. <\/span><\/p>\n

    1.5 Wear a reflective vest<\/b>: wearing a vest is required by law while on intercity roads and is also recommended for city roads. <\/span><\/p>\n

    1.6 In the event of accidents with no casualties<\/b>: clear the road as quickly as possible so as not to disrupt traffic, exchange information with the drivers involved in the accident and with witnesses and inform your insurance company.<\/span><\/p>\n

    1.7 Extracting Injured People from Vehicles<\/b><\/p>\n

    In general, Magen David Adom and the Police recommend <\/span>not<\/span> to move people injured in an accident; however, in the following cases, injured people must be extracted as quickly as possible:<\/span><\/p>\n

    Risk of fire following ignition.<\/span><\/p>\n

    The vehicle is pressing on the injured person\u2019s body.<\/span><\/p>\n

    The damaged vehicle contains hazardous or toxic materials. <\/span><\/p>\n

    The vehicle is unstable and may start rolling downhill.<\/span><\/p>\n

    The vehicle may be hit by another vehicle.<\/span><\/p>\n

    The injured person\u2019s life is in danger.<\/span><\/p>\n

     <\/p>\n

      \n
    • Before taking any action, consult with representatives of the emergency services. <\/span><\/li>\n
    • When extracting an injured person from a vehicle, take care not to move their spine and neck. <\/span><\/li>\n
    • If injured people cannot be extracted through the door, break one of the windows in order to reach the person, and if the person has been trapped under the vehicle, use a jack to raise the vehicle and extract the injured person.<\/span><\/li>\n
    • If the injured person is unconscious but breathing, lay them on their side. <\/span><\/li>\n
    • If an injured person is suffering from external bleeding, press your hand on the bleeding wound, apply a tight bandage, but don’t tighten it too much so as not to stop the flow of blood. Only use a tourniquet in cases where you cannot stop the bleeding in any other way. <\/span><\/li>\n<\/ul>\n

       <\/p>\n

      1.8 Exchanging Information with Drivers Involved and Documenting the Accident<\/b><\/p>\n

      It’s important to exchange information with the drivers involved in any accident, including minor accidents with no visible damage. The following important information must be written down immediately after the accident, and if a driver who was involved in an accident requests this information, you must provide it to them:  <\/span><\/p>\n

      1.9 Documentation of Accident Details<\/b><\/p>\n

        \n
      • The time of the event and the precise location<\/b> when and where it occurred. In addition, we recommend drawing a diagram describing the conditions of the road, including traffic lights and signs, the movements of the vehicles involved, and the direction they were traveling in. <\/span><\/li>\n
      • Details of the driver or drivers involved in the accident<\/b>: Note the full name, ID number, and driver\u2019s license number of the vehicle\u2019s driver. Look at the picture to confirm that the license does in fact belong to the driver. In addition, write down the driver\u2019s full name and all their contact information: Telephone numbers at home and at work, and mobile phone number. <\/span><\/li>\n
      • Insurance details of drivers involved in the accident<\/b>: Write down the details of the comprehensive insurance and mandatory insurance company, the policy number, and the policy expiration date. <\/span><\/li>\n
      • Vehicle details<\/b>: Note the vehicle\u2019s license number, model, color, and prominent identifying details. <\/span><\/li>\n
      • Witnesses to the accident<\/b>: If there were any witnesses to the accident, you can ask them to testify in the event of a police investigation or a lawsuit. Write down their full name, phone number, and ID number, so you can contact them.<\/span><\/li>\n
      • After exchanging information, contact the Vehicle Management Department for more instructions on further handling.<\/span><\/li>\n
      • Photographing the accident site<\/b> \u2013 We recommend documenting the damage caused by the accident and signs testifying to the circumstances. Vehicles involved in the accident: Photograph all vehicles involved in the accident; we recommend focusing on the damage caused to them.  Marks on the road: Photograph the marks the accident left on the road.  Road hazards and special conditions: Photograph various hazards on the road where the accident occurred, such as potholes, oil stains, or broken signage.<\/span><\/li>\n<\/ul>\n

         <\/p>\n

        Note:<\/b> If no injuries occurred in the accident, first clear the road and only then document the accident.<\/b><\/p>\n

         <\/p>\n

        1.10 Issuing Confirmation of Involvement in Traffic Accident<\/b><\/p>\n

        If you need confirmation of your involvement in an accident for your place of work, insurance company, or National Insurance, fill out the online form through the Israel Police website, print it out, and bring a copy or the reference number to your nearest police station. <\/span><\/p>\n

        1.11 Admitting guilt and the circumstances of the accident \u2013 do not admit guilt<\/b> and\/or make any written and\/or oral statements regarding your culpability in the accident \u2013 the insurance company may use your confession to deny liability, even if in retrospect it turns out that the confessing driver is not guilty.<\/span><\/p>\n\n\n\n
        \n

        Reporting to the Vehicle Unit<\/b> \u2013 <\/b>As soon as possible after the accident \u2013 State the details of the event, the condition of the passengers, and the state of the vehicle, and follow the instructions\/guidelines you receive.<\/b><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n



        <\/p>\n

          \n
        1. 2<\/i><\/b>. Courses of Action During a Breakdown or Emergency While Driving <\/i><\/b><\/li>\n<\/ol>\n

           <\/b><\/p>\n

            \n
          1. Pull over to the right shoulder as slowly and gradually as possible, and make sure to stop near the guard rail. <\/span><\/li>\n
          2. Exit the vehicle quickly and carefully and allow the passengers to exit safely. <\/span><\/li>\n
          3. Turn on your hazard warning lights.<\/span><\/li>\n
          4. Put on a reflective vest.<\/span><\/li>\n
          5. Place a warning triangle so that it is visible from a distance of 100 meters. <\/span><\/li>\n
          6. In the event that the problem occurs on a highway \u2013 Inform the <\/span>100<\/b> Police call center of the location the vehicle is stopped. <\/span><\/li>\n
          7. In the event that the problem occurs on the shoulders of Highway 6 \u2013 Call the <\/span>*6116<\/span> call center and report where you stopped.<\/span><\/li>\n
          8. Stand on the right side of the road (behind the guard rail, if any.)<\/span><\/li>\n
          9. Report to Netivei Israel (NTI) \u2013 *2120 and\/or the Carmel Tunnels \u2013 *5424.<\/span><\/li>\n<\/ol>\n

             <\/p>\n\n\n\n
            \n

            Drivers must apply their judgement and take all necessary precautions in order to ensure their safety, that of their passengers, and of others using the road.<\/b><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

            2.1 What do you do if you lose control of your brakes?<\/b><\/p>\n

              \n
            1. Press and release the brake pedal a number of times (as if you\u2019re inflating something).<\/span><\/li>\n
            2. If this doesn’t help:<\/span><\/li>\n<\/ol>\n
                \n
              • Try to slow the vehicle using the gearbox \u2013 gradually downshift (in automatic vehicles, downshift by moving the gearshift to 2 and then to 1, or using the system marked with + (plus) and – (minus) by moving the stick to the minus.<\/span><\/li>\n
              • Use the parking brake \u2013 raise\/operate it slowly (careful \u2013 hard braking can send the vehicle into a spin.)<\/span><\/li>\n<\/ul>\n
                  \n
                1. If you still can\u2019t slow the vehicle down \u2013 find an uphill emergency lane with, or, if there is no other option, try to slow your vehicle by gradually pushing against the guard rail. In any event, stop the vehicle at the side of the road in a safe spot and carry out the emergency actions listed in \u201c<\/span>Courses of Action During a Breakdown or Emergency While Driving.<\/span>\u201d<\/span><\/li>\n
                2. Note \u2013 shutting your engine as a last resort may be effective, but it involves certain risks:<\/span><\/li>\n
                3. \u201cHard\u201d steering wheel \u2013 the power steering system will stop working, and as a result, steering will be more difficult to control, especially at high speeds.<\/span><\/li>\n
                4. The risk that the brake amplifier won\u2019t work and the brake pedal will be very hard to press.<\/span><\/li>\n<\/ol>\n

                  2.3 What do you do when a tire bursts while driving?<\/b><\/p>\n

                  A tire bursting while driving can lead to loss of control of the vehicle and to an accident. In order to reduce the risk in advance, check that all of the vehicle’s tires are in order and check their pressure in accordance with the vehicle manufacturer’s instructions, which appear in the manual and in the table attached to the vehicle (usually on the driver’s door frame \u2013 visible when the door is open). <\/span><\/p>\n

                  When a tire bursts while driving, slow the vehicle and bring it to a stop in a safe place, even if that means destroying the tire and driving on the rim.<\/span><\/p>\n

                    \n
                  1. Hold the steering wheel firmly and control it while resisting the pull towards the burst tire.<\/span><\/li>\n
                  2. Slow the vehicle as much as possible using the brakes and the gearbox (in an automatic vehicle, down shift from D to 2 and from there to 1.)<\/span><\/li>\n
                  3. Stop the vehicle on the shoulders of the road in a safe location, as far as possible from the road.<\/span><\/li>\n
                  4. And carry out the emergency actions as detailed in \u201c<\/span>Courses of Action During a Breakdown or Emergency While Driving\u201d<\/b> and call the road service or a private service working for the insurance company.<\/span><\/li>\n<\/ol>\n

                    If no service is available, change the tire carefully and quickly in order to limit your exposure to roadside hazards.<\/span><\/p>\n

                      \n
                    1. Bring the vehicle to a garage or tire shop as soon as possible and check that all tires are in order.<\/span><\/li>\n
                    2. Spare tire: To save space and weight, some vehicles feature a reduced-size spare tire. Do not use this type of tire to travel long distances, just to the nearest tire shop. On intercity roads, drive to the tire shop at speeds not exceeding 80 km\/h.<\/span><\/li>\n<\/ol>\n

                      2.4 What do you do if your vehicle starts accelerating uncontrollably?<\/b><\/p>\n

                      Uncontrolled acceleration of a vehicle can occur as a result of mechanical problems, such as the gas pedal locking, or as a result of an electronic problem (a problem in the engine management computer, the cruise control system and so on). This is an emergency, in which the driver may lose control of the vehicle. What do you do?<\/span><\/p>\n

                        \n
                      1. Remain calm.<\/span><\/li>\n
                      2. Move the gearshift to Neutral.<\/span><\/li>\n
                      3. Slow down as much as possible using the brakes.<\/span><\/li>\n
                      4. If braking doesn\u2019t work, use the parking brake.<\/span><\/li>\n
                      5. Find an emergency lane on an ascending road.<\/span><\/li>\n
                      6. When the vehicle comes to a halt, turn off the engine.<\/span><\/li>\n
                      7. Try to stop the vehicle on the shoulders of the road, in a safe location<\/span><\/li>\n
                      8. And carry out the emergency actions listed in <\/span>\u201cCourses of Action During a Breakdown or Emergency while Driving.\u201d<\/b><\/li>\n<\/ol>\n

                         <\/p>\n

                        2.5 What do you do when the engine shuts down while driving?<\/b><\/p>\n

                        Vehicle engines may shut down mid-drive due to lack of fuel or an electrical\/mechanical malfunction.<\/span><\/p>\n

                        Remain calm. <\/span><\/p>\n

                        Try to merge to the right as much as possible, with preference for the shoulders.<\/span><\/p>\n

                        If your engine shuts down while the vehicle is in the middle of the lane and you have no way to stop on the right or on the shoulders, follow these rules and immediately call the police to report that a lane has been blocked.<\/span><\/p>\n

                        And carry out the emergency actions listed in <\/span>\u201cCourses of Action During a Breakdown or Emergency While Driving.\u201d<\/b><\/p>\n

                            1. 25<\/b>.<\/span> No person may drive a vehicle unless they are well-versed in its operation and use.<\/b><\/li>\n
                            2. 26<\/b>.<\/span> A person to which one of the following applies may not drive a vehicle:<\/b><\/li>\n<\/ol>\n

                                  (1) They are in a state that may pose a risk to road users;<\/span><\/p>\n

                                 (2) They are under the influence of narcotics or alcoholic beverages;<\/span><\/p>\n

                                 (3) They are incapable of driving the vehicle with a reasonable level of assurance due to their mental state or due to a physical weakness or disability;<\/span><\/p>\n

                                 (4) They are in a state that prevents them from controlling the vehicle or from seeing the road and its traffic.<\/span><\/p>\n

                               <\/p>\n

                                \n
                              1. <\/b> (a) <\/span>A person may not drive a vehicle if the vehicle is in a state that may pose a risk to road users.<\/b><\/li>\n<\/ol>\n

                                       (b) No person may drive a vehicle unless the structure, equipment, accessories, markings, and cargo capacity of the vehicle are in accordance with the Ordinance or these Regulations, including conditions featured in the permit and in the license.<\/span><\/p>\n

                                     (c) <\/span>No person shall drive a vehicle when the vehicle is in a state that precludes the driver form controlling it.<\/b><\/p>\n

                                  \n
                                1. Requirement to Hold the Wheel <\/b><\/li>\n<\/ol>\n

                                   <\/b>(a) A person driving a vehicle must hold the steering wheel in their hands so long as the vehicle is in motion; however, they may remove one hand from the wheel if they must use it to ensure the proper operation of the vehicle or to follow the rules of the road.<\/span><\/p>\n

                                  (b) When the vehicle moving, the driver \u2013<\/span><\/p>\n

                                  (a) Shall not hold a fixed or mobile phone, nor use them in a vehicle unless while using a hands-free device;<\/span><\/p>\n

                                  (b) Shall not send or read text messages;<\/span><\/p>\n

                                       (2) <\/b>\u201cHands-free device\u201d \u2013 a device that allows a telephone to be used without being held, so long as if the device is located on the phone, the phone is placed in the vehicle in a stable manner so as to prevent it from falling.<\/span><\/p>\n


                                  <\/b><\/p>\n

                                    \n
                                  • Behavior in Traffic Accidents<\/b><\/li>\n<\/ul>\n

                                     <\/p>\n

                                      \n
                                    1. 144<\/b>. (a) <\/span>A driver of a vehicle involved in an accident as a result of which a person was killed or injured <\/b>shall follow these instructions:<\/span><\/li>\n<\/ol>\n

                                      (1) Immediately stop the vehicle at the scene of the accident or as close to it as possible, and shall not move from that place unless it is necessary to use the vehicle to carry out that stated in paragraph (2) or if permitted to do so by a police officer;<\/span><\/p>\n

                                      (2) In accordance with the circumstances of the incident and the site of the accident, appropriate assistance shall be provided to any person hurt in that accident, and in particular:<\/span><\/p>\n

                                      (a) Make sure to prevent any additional damage to the injured party;<\/span><\/p>\n

                                            (b) Offer the injured person first aid to the degree they are qualified to provide;<\/span><\/p>\n

                                            (c) Shall call the professional rescue services to the scene of the accident that are needed according to the circumstances, among other things, ambulances, police and the fire department;<\/span><\/p>\n

                                           (d) Wait with the injured party until the professional rescue services arrive;<\/span><\/p>\n

                                           (e) If it is impossible to evacuate the injured person via ambulance, make sure to have them transported in some other suitable vehicle to a first aid station, hospital, or doctor.<\/span><\/p>\n

                                      (3) Remit to a police officer, or to an individual who was hit, or to the driver of another vehicle involved in the same accident, or to any passenger or person who was in the injured party\u2019s company, their name and address, their driver\u2019s license and registration number of the vehicle they are driving, and the name and address of their owner, and shall present to them, at their request, the vehicle license or insurance certificate and their identification if it is in their possession and allow them to copy any detail listed in them;<\/span><\/p>\n

                                      (4) Immediately notify, using the fastest means of communications available, the police station closest to the scene of the accident about the accident and specify the following:<\/span><\/p>\n

                                      (a) Their name and address;<\/span><\/p>\n

                                      (b) The location of the event and their location, and if they know – also the name of the person who was injured and where that person was sent for treatment.<\/span><\/p>\n

                                      (c) No person may move a vehicle involved in the accident as stated in Sub-Regulation (a) unless permitted to do so by a police officer, or if needed in order to provide assistance to people involved in this accident.<\/span><\/p>\n

                                       <\/p>\n

                                        \n
                                      1. 145<\/b>. <\/span>(a) The driver of a vehicle involved in an accident or damage to another vehicle,<\/b> or other property, other than a vehicle, located on the road or near it, and who caused damage to said other vehicle or property, shall immediately provide the driver of the other vehicle or the owner of the property or their supervisor or to a police officer at the scene, their name and address, their driving license number and the registration number of the vehicle they were driving and the name of its owner and their address, as well as the insurance certificate number and the name of the insurance company, and shall present at their request these certificates and the vehicle license and shall permit them to copy any information listed therein.<\/span><\/li>\n<\/ol>\n

                                            <\/span> (b) <\/b>If vehicles involved in an accident or impact standing at the scene of its occurrence are causing or may cause a traffic disruption, their drivers shall clear the road to allow traffic to flow freely and immediately thereafter shall comply with Sub-Regulation (a).<\/span><\/p>\n

                                              <\/span>(c) If the other damaged vehicle is unsupervised, or the owner of the property or the person responsible for it is not at the site \u2013<\/b><\/p>\n

                                        (1) The person driving the vehicle involved in the accident or impact shall leave a written message on the damaged vehicle, in a prominent location, and as much as possible shall also do so regarding damaged property, specifying the details mentioned in Sub-Regulation (a);<\/span><\/p>\n

                                        (2) The driver of the vehicle shall notify the police station closest to the scene of the accident or impact within 24 hours of the accident of the event and shall specify their name and address, unless details were provided to a police officer at the scene and the name and number of the police officer, if known.<\/span><\/p>\n

                                          \n
                                        1. 146<\/b>. <\/span>A driver of a vehicle driving past a traffic accident in which an injured person is located<\/b>, shall stop and not continue driving until they have done all they can to provide any help needed by the injured party or to come to their aid in accordance with Regulation 144(a)(2).<\/span><\/li>\n<\/ol>\n

                                            \n
                                          1. Other Traffic Regulations <\/b><\/li>\n<\/ol>\n

                                             <\/p>\n

                                            10.b – <\/b>Prohibition of driving without a driving license:<\/b><\/p>\n

                                            A vehicle owner and person having control over a vehicle shall not permit another to drive the vehicle if they are not authorized to do so according to Sub-Section (a); that said, the vehicle owner or whoever has control over the vehicle, shall not be liable for the driving of a person unauthorized to drive it, if they can prove that they took all reasonable measures to prevent that person from driving the vehicle.<\/span><\/p>\n

                                            27.b Vehicle Owner\u2019s Liability <\/b><\/p>\n

                                            (a) Whereupon a traffic violation in was committed a vehicle, the vehicle owner shall be deemed to have driven the vehicle at that time or to have permitted it to be driven or to have parked it in a place in which it is prohibited by law to be permitted to drive or park, as applicable, unless they can prove to whom they transferred possession of the vehicle (hereunder – the Possessor), or it has proven that the vehicle was taken from them without their knowledge and consent.<\/span><\/p>\n

                                            36.b Driver of a Vehicle Without the Owner\u2019s Permission<\/b><\/p>\n

                                            (a) Any person driving a vehicle without the permission of the owner or the lawful possessor of the vehicle, and without the driver holding a valid driving license for that type of vehicle, shall be disqualified from holding or receiving a driver\u2019s license for a period of no less than three years, in addition to any other punishment decided on by the Court,<\/span><\/p>\n

                                             <\/p>\n

                                            (c) The owner of a vehicle or person controlling a vehicle, who has permitted another person to drive it knowing that the person does not hold a driving license for that type of vehicle, shall be liable for three years\u2019 imprisonment, with or without a fine, and if that person was a minor who is unable to obtain a driving license – five years\u2019 imprisonment with or without a fine<\/span><\/p>\n

                                             <\/p>\n

                                            162 Liability of Person Holding the Vehicle<\/b><\/p>\n

                                             (a) The vehicle owner, or whoever had control over the vehicle, shall not instruct and shall not allow the driver of the vehicle to drive it, to stop it or park it in any manner contrary to regulations, including the bylaws, enacted under the Ordinance.<\/span><\/p>\n

                                             (b) Wherever the provisions in this part impose liability upon the driver of a vehicle, liability shall also apply to the owner of the vehicle; unless the vehicle owner can prove that the offense was committed without their knowledge and consent or they took all reasonable means to prevent it from being committed.<\/span><\/p>\n

                                             <\/p>\n

                                              \n
                                            1. Refueling the Vehicle<\/b><\/li>\n<\/ol>\n
